The bill would make it illegal for companies to ship goods that endanger Americans, either knowingly or unintentionally. "We could be talking about the next incident, in which case it would be too late," said Senator Tom Harkin, chairman of the Senate Committee on Health, Education, Labor and Pensions. "We have to stop shipping toxic or hazardous products from China. There's no excuse for it," said Representative Bart Stupak, the Michigan Democrat who sponsored the bill. The measure would make it illegal to ship toxic or hazardous materials across state lines, something that has happened before, said Stupak. U.S. regulators have known for several years that some American companies have shipped toxic products to China, from medical devices to toys. In April, the Obama administration announced an investigation into the shipments. Stupak said U.S. companies are growing more aggressive in their marketing and marketing is the greatest profit center for many U.S. businesses. "So I think we are only going to hear more of these marketing campaigns, more aggressive advertising, more marketing campaigns from these companies," Stupak said. "And the average American consumer is not sophisticated enough to even know what the [U.S. regulations are]." Companies are getting caught up in short-term market pressures, while the long-term benefits of a stable market and a healthy, educated consumer base are at risk, Stupak said. "If we don't get this right, the American economy is going to pay a big price in health care and in other areas," Stupak said. "And it's hard to believe that a company would do this intentionally." The industry responsible for toxic product shipments has been growing by leaps and bounds over the past decade, according to a March 2008 study by the American Chemistry Council.
